All products and information displayed on Hemplanet.in (hereinafter “Hemplanet.in” or the “Website”) constitute an "invitation to order". Your order for purchase constitutes your "order" which shall be subject to the terms and conditions as listed below. If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details and therefore process the order.
1 - USERS ELIGIBILITY
Use of Hemplanet.in is available only to persons who can legally form contracts under applicable law. Persons who are deemed "incompetent to contract" within the meaning of the Indian Contract Act, 1872 are not eligible to use the Website. If your age is below 18 years old, your parents or legal guardians can transact on your behalf, if they are registered users.
Hemplanet.in reserves the right to terminate your membership and refuse to provide you with access to the Website if Hemplanet.in discovers that you are under the age of 18 years. The Website is not available to persons whose membership has been suspended or terminated by Hemplanet.in for any reason whatsoever. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement.
2 - ACCOUNT AND REGISTRATION OBLIGATIONS

Hemplanet may introduce new services and modify some or all of the existing services offered on the website at its sole discretion. In such an event, Hemplanet reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee policies shall be posted on the website, and such changes shall automatically become effective immediately after they are posted.
4 - OUR PRODUCTS
All products offered by Hemplanet are described and pictured as completely and precisely as possible and in good faith. Despite all our precautions, Hemplanet cannot be held liable for possible errors.
Regarding the colors, we have made every effort to display the colors of our products that appear on the website as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.
5 - PRICING INFORMATION
While Hemplanet strives to provide accurate product and pricing information, pricing or typographical errors may occur. Hemplanet cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Hemplanet shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, Hemplanet may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted, and Hemplanet will have the right to modify the price of the product and contact you for further instructions using the email address provided by you during the time of registration or cancel the order and notify you of such cancellation. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.
6 - Payment Process
Hemplanet offers online payment options via credit or debit card. Upon providing your card information, Hemplanet will obtain a pre-approval from the card company for the amount of the order. Your credit card will be billed or a transaction will be processed under your credit or debit card before your order ships. Visa, MasterCard, American Express, and Paypal payments are accepted. Please note that debit cards may have daily spending limits that could significantly delay the processing of your order. Hemplanet requires the security code for your card to protect against unauthorized use by others. The security code is a three- or four-digit number unique to your card that may be printed on the front or back of your card. We, as a merchant, shall not be liable for any loss or damage arising directly or indirectly from the decline of authorization for any transaction due to the cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
7 - Credit Card Details
You confirm that the credit card details provided by you for availing of services on Hemplanet will be correct and accurate, and you shall not use a credit card that is not lawfully owned by you. You agree and undertake to provide the correct and valid credit card details to Hemplanet. The said information will not be shared by Hemplanet with any third parties unless required by law, regulation, or court order. Hemplanet will not be liable for any credit card fraud. The liability for the fraudulent use of a card will be on you, and the charge to prove otherwise shall be exclusively on you.
8 - Secure Payment
Hemplanet is highly concerned about secure payment processes. That is why certified companies, ICICI Bank, and Paypal, which guarantee 100% secure transactions, are utilized to process payments.
9 - Fraudulent or Declined Transactions
Hemplanet reserves the right to recover the cost of goods, collection charges, and lawyer's fees from persons using the Website fraudulently. Hemplanet reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these terms and conditions.
10 - Transport and Delivery of your order:
The goods purchased are delivered within the stipulated period by recorded delivery or via courier service to the delivery address indicated by the purchaser on the order. If you order several articles, the consignment will only be dispatched when all the articles are in stock. If the order could not be delivered within 30 working days, Hemplanet will dispatch the out-of-stock article separately to the purchaser after this period. If stocks are exhausted or if a product cannot be delivered within 8 weeks (56 days), Hemplanet will contact you to agree on an acceptable delivery period or to cancel the order completely free of charge. Hemplanet cannot be held liable for any damages that might ensue from a product being out of stock or from delayed delivery.
11 - Dispatch and Transport:
Hemplanet offers a complete transport service for purchases, utilizing renowned transport companies and courier services. Products can be delivered worldwide. All consignments are recorded, and you must sign for receipt.
12 - Loss or Damage during Transport:

Loss and/or damage of a product that has been ordered will be borne by Hemplanet. You are responsible for checking the goods on receipt. If any external damage is noticed, you are required to take photographs and send them to Hemplanet within 5 working days via email. Hemplanet reserves the right to refuse your request if this term is not respected.
13 - Cancellation Policy:
Cancellation of Order by Hemplanet:
Please note that Hemplanet reserves the right to refuse or cancel any order for any reason. Some instances that may lead to cancellation include limitations on available purchase quantities, pricing inaccuracies or errors, or issues identified by the company. In the event of a canceled order after charging the credit card, the charged amount will be refunded.
14 - Cancellation of Order by the Customer:
Customers may refuse a purchase within seven working days of receipt of the product. To notify Hemplanet of the cancellation, the customer must send an email via the provided link on the website. Goods must be returned undamaged, unopened, and in the original packaging within five working days of notification. Custom-made products cannot be canceled, and refundable sums will be paid minus delivery costs. Carriage for the return of goods is payable by the purchaser. Hemplanet refunds carriage costs only if the purchaser did not receive the product that was ordered or if the product arrived damaged. Returned articles with open packaging or products that have been used or damaged by the purchaser will not be accepted or refunded.
15 - Customer Undertaking:
By using Hemplanet's services, the customer undertakes to use the website's services for lawful purposes only and to comply with all applicable laws and regulations while transacting on the website. Customers are responsible for providing authentic and accurate information when requested. If found not to be true, Hemplanet reserves the right to reject registration and debar the customer from using their services. 20 - MODIFICATION OF USER AGREEMENT
Hemplanet may at any time modify the User Agreement without any prior notification to you. Subsequent to any modification of the User Agreement, we will inform you of the modifications in the User Agreement via email at the address provided by you while registering on Hemplanet. You can access the latest version of the User Agreement at any given time on Hemplanet. You should regularly review the User Agreement on Hemplanet. In the event the modified User Agreement is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified User Agreement.
21 - GOVERNING LAW AND JURISDICTION
This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Pondicherry shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Hemplanet and its decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Pondicherry.
22 - INDEMNITY
You agree to defend, indemnify and hold harmless Hemplanet, its employees, executives, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Hemplanet or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, fraudulent transactions or other rights. This clause shall survive the expiry or termination of this User Agreement.
23 - TERMINATION
This User Agreement is effective unless and until terminated by either you or Hemplanet. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Website. Hemplanet may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Website. Such termination will be without any liability to Hemplanet. Upon any termination of the User Agreement by either you or Hemplanet, you must promptly destroy all materials downloaded or otherwise obtained from this Website, as well as all copies of such materials, whether made under the User Agreement or otherwise. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.
24 - ENTIRE AGREEMENT
Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the services of Hemplanet you agree to be bound by the Terms and Conditions.
25 – SEVERABILITY
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
